Contract の Performance

　Contract の Performance (履行) 。

　Contract は、Performance によって Discharge (消滅) となる。

　Contract を Discharge する要因は、

　・Performance
　・Breach of contract
　・Agreement
　・Operation of low

◎Performance
　Contract の履行。

　Performance には、Condition がつく場合がある。　

　・Condition precedent
　・Condition subsequent
　・Concurrent condition　

◎Breach of contract
　Contract の違反。Contract の Parties による Contract の Breach 。

　・Material breach
　・Partial breach
　・Anticipatory breach　

　Breach of contract を受けた側は、Mitigation of damage を行う。Breach of contract には、Remedies がある。　

○Anticipatory breach
　Contract の Due (期限) 前に、Performance できない旨をつたえる。Anticipatory repudiation 。　

　Anticipatory breach を受けたら、

　・Sue at once
　・Contract の Cancel
　・Wait until due and Sue
