Trust　-Complex trust は Principal の Distribute を行える-　USCPA

　信託。Property の Legal title をもつ者と、Property の Benefit を受ける者との Fiduciary relationship (信認関係)。

　Trust では、Legal title と、Benefit を受ける Equitable title が分かれている。

Simple trust は、Each year の All income を Distribute 、Trust principal の Distribute を行えない、Charitable contributions を行えない

Complex trust は、Income の Distribute と Accumulate の Discretion (裁量) をもつ、Trust principal の Distribute を行える、Charitable contributions を行える　

◎Trust の Law
　Trust に関する Law は、Restatements of the Law of Trust 。

◎Trust の Creation
　Trust を Creation するのに必要な Components がある。

・Settlor
・Trust property
・Trustee
・Beneficiary

○Settlor
　委託者。Trust を Creation する。

Settlor は、Trustee (委託者) に Trust property (信託財産) を譲渡する。

Settlor も Trustee (委託者) や Beneficiary (受託者) の一人となることは可能だが、単独の Trustee や Beneficiary になることはできない。

○Trust property
　信託財産。Settlor が Trustee に譲渡する。Creation の時点で、Trust property は決まっていなければならに。

○Trustee
　委託者。Settlor から譲渡された Trust property を Administration (管理) を行い、Benefit を Beneficiary に Distribute する。

Trustee が Trust property の Legal title をもつ。

以下に該当すると、Court が Trustee を指名する。

・Settlor が Trustee の選任をしなかった
・Settlor に指名された者が、Trustee の資格をもっていなかった
・Settlor に指名された者が、Trustee になることを辞退した

○Beneficiary
　受益者。Trust property からの Benefit を受け取る。

Beneficiary が Trust property の Equitable title をもつ。

○Simple trust

　→ Each year の All income を Distribute

　→ Charitable contributions を行える

明示的な Trusts 。Settlor の Trust の Creation が Express (明示) されている Trusts 。

Trust property が Real property ならば、The statue of frauds によって、書面が必要となる。

　Trustee は Trust の Administration を行う。

　Trustee は、3つの Primary duties をおう。

　・Duty of loyalty 　

○Prudence and care に Act
Trustee は、Prudence (慎重) に Care (注意深く) に管理を行う。

以下の Act には、とくに Prudence and care

・Principal (元本) と Income (収益) の Distribution
・Creditor への Payment
・Record の Maintaining
・Benefit に関する Decision

○Duty of loyalty
忠実義務。Trustee は、Beneficiary の Benefit のために Act を行わなければならない。

◎Trustee of powers
Trustee の Powers (権限) は、Settlor から Agreement で与えられる。また、Jurisdiction の Law の影響も受ける。

通常、Trust に必要な合理的な Powers は認められる。
